Recommended With An Asterisk?

The American Bar Association’s Standing Committee on the Federal Judiciary has issued a new statement with respect to the nomination of Brett Kavanaugh to be an Associate Justice on the United States Supreme Court which provides in full as follows:

New information of a material nature regarding temperament during the September 27th hearing before the Senate Judiciary Committee has prompted a reopening of the Standing Committee’s evaluation. The Committee does not expect to complete a process and re-vote prior to the scheduled Senate vote.

Our original report must be read in conjunction with the foregoing. Our original rating stands.

I haven’t the slightest idea of what this means.  Assume that the Committee later determines that Kavanaugh is unqualified.  At that point, so what?

  1. A long shot. By common agreement and the copious evidence from his confirmation hearing, Brett Kavanaugh is a dick, in the élite Ted Cruz league. Will Mr. Justice Kavanaugh be able to get on with his conservative colleagues, or repel them to the extent of making him a net liability to Roberts’ conservative caucus? Scalia by all accounts had an engaging personality in social interactions. The effect on the family’s Overton windows of a mad uncle muttering to himself in the corner is hard to predict.
